2005 CDSOA Payout Schedules Including Uncollected Duties

The U.S. Department of Customs and Border Protection has released its final report, listing how fiscal 2005 funds will be disbursed, as required by the Continued Dumping and Subsidy Offset Act of 2000. In a nutshell, the CDSOA instructs U.S. Customs to accumulate dumping duties assessed on goods found to have come into the U.S. at below-market value, replacing a system which put those duties into the general Treasury fund. Accumulating the duties over the course of a government fiscal year, those funds are then paid out to the companies in industries successfully claiming damage from that class of goods. Each year, the companies involved in the original complaints are required to file claims for their share of the dumping duties, which are then paid out as a percentage of the claimed damages. However, some cases still have uncollected duties pending, in several instances amounting to millions of dollars. When those uncollected duties are received and processed, they will also be paid out, when received.
